A Federal High Court in Abuja has ordered the Ebonyi State Governor, Dave Umahi and his deputy, Eric Igwe, to vacate their seats as the sitting governor and deputy respectively, on grounds that they defected from Peoples Democratic Party (PDP) to All Progressives Congress (APC) and won the election on March 2019 on PDP and not as APC candidates.
The Justice, Justice Inyang Ekwo, in a judgement, on Tuesday today, held that their defection was unconstitutional.
The governor on his second term, joined the APC in 2020 with his deputy the speaker and some lawmakers.
In his ruling, justice Ekwo ordered all the lawmakers who defected to vacate their seats.
The judge held that all salaries and allowances collected from the period of defection to the present should be forfeited to the government coffers.
Justice Inyang Ekwo, cited section 221 of the Constitution and ordered the PDP immediately to send names of replacements to INEC so that fresh elections can be conducted.
Nigeria is now legally moving in the direction of law and order.
