A High Court of the Federal Capital Territory (FCT), Abuja, has issued a Form 48 a formal Notice of Consequences of Disobedience to Court Order against Senator Samuel Anyanwu and the Chairman of the Independent National Electoral Commission (INEC), Prof. Joash Ojo Amupitan, over alleged non-compliance with a subsisting court judgment.

The notice stems from a ruling delivered on January 12, 2026, in Suit No. CV/1050/2025, in which the court dismissed Anyanwu’s challenge to his expulsion from the Peoples Democratic Party (PDP), effectively affirming the party’s decision.
Senior figures within the PDP, led by Acting National Chairman, Amb. Iliya Umar Damagum, maintain that the judgment remains valid and enforceable, stressing that the filing of a Notice of Appeal does not operate as a stay of execution.
The party has formally petitioned INEC to withdraw recognition of Anyanwu as its National Secretary and expunge his name from the commission’s official records.
Form 48 is a statutory precursor to contempt proceedings, signaling potential legal consequences, including imprisonment, should the parties fail to comply with the court’s directive.
